Terms of Service.

Who we are

NasrLabs is a sole proprietorship registered in India under Udyam, operated by Aqil Rasheed, at 12, Ambalakunnummal, Koodathai Bazar, Thamarassery, Kozhikode, Kerala 673573, India. In these terms, "we" and "NasrLabs" mean that business, and "you" means the client or user.

Services

NasrLabs provides:

• AI messaging automation for Instagram and WhatsApp
• WhatsApp Business API setup and migration
• Product database and inventory automation
• Custom web development

The exact scope, price, timeline and deliverables of any engagement are set out in an individual written agreement between NasrLabs and the client. Where that agreement and these terms conflict, the written agreement governs.

Acceptable use

You agree not to use our services to send spam or bulk unsolicited messages, to break the law, to impersonate another person or business, to sell prohibited or illegal goods, to harass anyone, or to handle personal data you have no right to handle.

You are responsible for the content your business sends through systems we build, and for the accuracy of the product, pricing and order information you supply to us.

We may suspend or stop a service if it is being used in breach of this section.

Automated replies are AI-generated

Replies produced by these systems are generated by AI and may contain errors. They can misread a question, state something inaccurate about a product, or handle an edge case badly.

The systems we build are tools that assist a business, not a replacement for human judgement. Clients are responsible for reviewing how their system behaves and for any commercial decision made on the basis of an automated reply. We recommend human oversight for orders, pricing and anything else that carries financial consequence.

No warranty of uninterrupted service

We do not warrant that any service will be uninterrupted, error-free, or available at all times. These systems depend on third-party platforms and networks that we do not control, and outages, rate limits and delivery failures can occur.

Services are provided on an "as is" and "as available" basis, without warranties of any kind except those that cannot be excluded under applicable law.

Limitation of liability

To the maximum extent permitted by law, NasrLabs is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost sales, lost data or loss of goodwill, arising from the use of or inability to use our services.

To the maximum extent permitted by law, our total liability for any claim arising out of an engagement is limited to the amount paid by the client to NasrLabs for that engagement in the three months before the claim arose.

Nothing in these terms excludes liability that cannot lawfully be excluded.

Third-party platforms

Our services run on platforms operated by others, including Meta Platforms (Instagram and WhatsApp), Google and OpenAI. Your use of those platforms is also governed by their own terms and policies, and you are responsible for complying with them.

Those platforms can change their policies, pricing, APIs or approval requirements at any time, and such changes may affect, limit or interrupt the service. Changes of that kind are outside our control, and we are not liable for their effects. We will tell clients when we become aware of a change that materially affects their system.

Platform accounts can also be restricted or suspended by the platform itself. We cannot guarantee the outcome of any platform review, verification or approval process.

Intellectual property

This website, and the underlying systems, code, prompts, templates and tooling NasrLabs uses to build its services, remain the property of NasrLabs. Nothing in an engagement transfers ownership of that underlying tooling unless the written agreement says so explicitly.

Content you supply, including your brand assets, product data, catalogue images and customer data, remains yours. You grant us the permission needed to use that material for the purpose of delivering the service to you.

Deliverables built specifically for a client are handled as set out in that client's written agreement.

Fees

Fees, payment schedule and any recurring charges are set out in the written agreement for the engagement. Third-party costs, such as platform, messaging or API fees charged by Meta, Google, OpenAI or hosting providers, are separate from our fees unless the agreement states otherwise.

Termination

Either party may end an engagement in line with the written agreement for it. We may suspend or end a service immediately if these terms are breached, if the use is unlawful, or if a third-party platform requires it.

On termination, we will stop operating the service. Fees already due remain payable. Data handling after termination follows our Privacy Policy, and a client or customer may request deletion through the data deletion page.

Privacy

Personal data handled through our services is governed by our Privacy Policy.

Changes to these terms

We may update these terms. When we do, we will change the "Last updated" date at the top of this page. Continued use of our services after an update means the updated terms apply.

Governing law

These terms are governed by the laws of India. The courts at Kozhikode, Kerala have jurisdiction over any dispute arising from them.
